Passenger Support - Terms of Use

Please read these terms (“terms”, “Agreement”) carefully before using the
(https://retailinmotion.atlassian.net/servicedesk/customer/portal) website (“website”, “service”) which is [operated] by [Retail inMotion Europe GmbH] (“us”, “we”, “our”).

Conditions of use

By using this website to submit support requests to Retail inMotion, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website. We only grant use and access to this website, its products, and its services to those who have accepted the terms. So, if you do not accept these terms, we will not be able to process your order.

Privacy policy

Before you continue using our website, we advise you to read our Privacy Policy regarding our user data collection. It will help you better understand our practices. The use of this website necessitates the collection of certain user data to process your request. By using this website, you accept the Privacy Policy and consent to it to process your request.

Products and services

We cannot be held responsible should there be discrepancies in size, shape, or colour, with the products ordered and received by you. All products displayed on this website are for illustrative purposes only and available only whilst stocks last.

Errors do happen and we reserve the right to correct wrong information; such as prices, overcharges, warranty requests, refund requests and to cancel or refuse to process an order that was made based on the incorrect information.

You can raise a support request to us about the following categories:

  1. Refund requests
  2. Warranty requests
  3. Preorder requests
  4. Other support requests

 

  1. Refund Requests: Refunds for buy on board items, fresh food (such as sandwiches on board), preorder meals, cosmetic products and tobacco products are not applicable. Refunds can be only done within thirty (30) days and / or one (1) month after the transaction. We reserve the right to ask for a return shipment of the product with cost born by the sender. We will require a photo proof of the receipt, flight and passenger related details and reserves the right to refuse a refund if sufficient proof is not available or the product category is not applicable for a refund. Payments with Miles and / or Points is dependent on the user’s point balance and system availability. If the total transaction amount is not redeemable with Miles, in other words, if the member’s point balance is insufficient to pay for the transaction with Miles or Points in full; then the credit card of the user will be charged. Partial point redemptions and recharges from the credit cards in not possible. We do not bear any responsibility for Miles programs, and will only fully reimburse successful Miles or Points redemptions. Partial redemptions of purchases are evaluated on a case-by case basis and may take longer than expected or may not be possible depending on technical capabilities of your bank and processing details. In this case, we will do our best to perform a refund, but we will not be responsible for the capabilities of any external parties.

  2. Warranty Requests: The warranty period of a product that was purchased on board is noted in its original box. This period can vary based on the product. We will not refund or replacement of the product if the warranty period is over. We will require a photo proof of the product that is subject to the warranty, and an invoice of the transaction in addition to applicable flight related details to process the request. We reserve the right to ask for a return shipment of the product with cost born by the sender. To process warranty requests, we may require additional data to perform a wire transfer. The requestor consents to provide the data required and storage of the data for two (2) to ten (10) years. This data will not be processed and kept confidential as a record to the warranty claim based on the request. We reserve the right to not process a warranty request if sufficient proof, information or consent is not available.

  3. Preorder Requests: If redirected, you can raise a request for a special service request from or provide feedback to us about the quality of the Preorder that is received onboard. We reserve the right to deny, reject, refuse or void the request if sufficient information or proof is not available. We might require additional details about the flight of the raised query and supporting documentation in each circumstance, and by using this website, the requestor consents to processing and storage of data from two (2) to ten (10) years.

  4. Other Support Requests: It is possible to raise requests about general quality of onboard services. These requests will be collected and processed anonymously to improve the services provided on board. We may request additional data from you to clarify and understand the request better. This data will be processed anonymously for general feedback, and in safety and quality cases, will be stored and followed up on a case-by-case basis. By using this feedback tool, the requestor consents the use, storage and processing of their data by relevant parties that are directly contracted by us.

For any or all the above requests, you consent to the use, storage, and processing, of your data by us, in accordance with our Privacy Policy. Your data will only be retained for as long as is necessary to complete the request(s) or as required by contract and/ or law.

Age restriction

You must be at least 18 (eighteen) years of age before you can use this website. By using this website, you warrant that you are at least 18 years of age and that you may legally adhere to this Agreement. We assume no responsibility for liabilities related to age misrepresentation.

Intellectual Property

You agree that all materials, products, and services provided on this website is our property and that of our affiliates, directors, officers, employees, agents, suppliers, or licensors, including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute any of our intellectual property in any way, including electronic, digital, or new trademark registrations.

User accounts

As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content between our systems and contractors as necessary, and cancel requests at our sole discretion if the consent is revoked, incomplete, inaccurate, insufficient or invalid.

Applicable Law

By using this website, you agree that the laws of Germany, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between you and us, or our business partners and associates.

Indemnification

You agree to indemnify us and our affiliates and hold us harmless against legal claims and demands that may arise from your use or misuse of our services.

Limitation on liability

We are not liable for any damages that may occur to you because of your misuse of our service or our website.

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this Agreement.

We only supply the products for domestic and private use. You agree not to use the product for any commercial, business, or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our liability for, death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

Changes

We reserve the right to edit, modify, and change, this Agreement at any time. We shall let our users know of these changes through the website or electronic mail. This Agreement is an understanding between us and the user and supersedes and replaces all prior agreements regarding the use of this website.

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations caused by any act or event beyond our reasonable control (including without limitation, flood, drought, earthquake or other natural disaster, fire, explosion or accident, pandemic, cyber-attack, labour or trade disputes or strikes, non-performance by suppliers or subcontractors or interruption or failure of a utility service). We will contact you as soon as reasonably possible to notify you if any of our obligations will be suspended or delayed.

General

These terms set out the entire understanding and agreement between you and us in relation to your purchase of products from us. No other person shall have any right to enforce these terms.

Nothing in these terms shall create or imply any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between you and us.


If any provision in these terms is held to be invalid or unenforceable, such provision shall be struck out and the rest of the terms shall remain in full force and effect.

You may only transfer your rights or your obligations under these terms to another person if we agree in writing.

Our failure to act with respect to a breach by you or others shall not be considered as a waiver of our right to act with respect to subsequent or similar breaches.
